Terms of Service
These Terms of Service describe the rules for using the SystemService website, platform, service workflows and related digital services.
1. Scope of these terms
These terms apply to the use of the SystemService website, platform, user accounts, service workflows, public repair intake, status pages, subscriptions and related digital services.
Additional written agreements may apply to business customers, including subscription agreements, service arrangements or data processing agreements. If such an agreement conflicts with these terms, the written agreement prevails for that specific customer.
2. What SystemService provides
SystemService provides software and related services for managing service requests, repair workflows, devices, customer communication, technical records, warehouse information and operational processes.
The platform may include different workspaces and roles, such as client, employee, administrator and platform owner roles. Access to functions depends on the user role and the configuration of the customer account.
SystemService may also provide direct service or repair-related intake through public forms or status pages, depending on the service model offered at that time.
3. User accounts and access
Users are responsible for keeping login credentials secure and for using the platform only within their authorised role and organisation.
Accounts may not be shared with unauthorised persons. If a user suspects unauthorised access, they should notify SystemService or the relevant account administrator as soon as possible.
SystemService may suspend or restrict access where this is necessary for security, misuse prevention, legal compliance or protection of the platform.
4. Business customers and platform use
A business customer using SystemService is responsible for the data, users, service requests, files and content entered into its own workspace or tenant environment.
The business customer must ensure that its users have the necessary rights and authority to use the platform and to enter data relating to customers, devices or service operations.
Where required by data protection law, the relationship between the business customer and SystemService may be governed by a separate data processing agreement.
5. Subscriptions, billing and payments
Access to certain platform functions may require an active subscription, trial or written arrangement with SystemService.
Subscription prices, billing cycles, included features and payment terms are presented before purchase or agreed separately with the business customer.
Payments may be processed by external payment providers. SystemService does not store full payment card details.
6. Repair and service-related rules
Where SystemService accepts a physical device or service request for diagnosis or repair, initial times, costs and results may be indicative until the device has been reviewed.
If additional work, parts or costs are required, SystemService or the relevant service provider will inform the customer before continuing, unless otherwise agreed.
The customer is responsible for properly packaging and shipping devices, unless another arrangement has been confirmed.
Electronic devices may already be unstable or damaged when submitted. During diagnosis or repair, additional defects may become visible and in some cases the condition of the device may worsen despite reasonable care.
7. Customer responsibilities
Customers must provide accurate information, use the platform lawfully, respect account permissions and avoid uploading unlawful, unnecessary or excessive data.
Customers must make their own backups of data stored on devices before submitting a device for diagnosis or repair.
Customers may not misuse the platform, attempt unauthorised access, interfere with security measures or use SystemService to process data in violation of applicable law.
8. Data, files and device access
Users should only upload files and information that are necessary for the relevant service, request, communication or platform function.
If access to a device is required for service purposes, the customer should provide only the access information that is necessary and should remove or protect private information where possible.
SystemService does not guarantee the preservation of data stored on devices submitted for diagnosis or repair, unless this is expressly agreed as a separate service.
9. AI-assisted features
SystemService may include AI-assisted features for guidance, search, summaries, workflow support or technical assistance.
AI-generated output is supportive only and should not be treated as legal, financial or final technical advice. Users remain responsible for checking important information before acting on it.
Users should not enter sensitive, unnecessary or confidential information into AI-assisted features unless it is required for the intended function and permitted by their organisation.
10. Availability and maintenance
SystemService aims to keep the website and platform available and secure, but availability may be affected by maintenance, updates, hosting providers, internet disruptions, security incidents or force majeure.
SystemService may perform maintenance or updates to improve security, performance, functionality or legal compliance.
11. Intellectual property
The SystemService platform, design, software, branding, texts and related materials are owned by SystemService or its licensors, unless stated otherwise.
Users receive only the right to use the platform according to these terms and any applicable agreement. No intellectual property rights are transferred.
12. Consumers, distance contracts and withdrawal rights
Where SystemService offers services directly to consumers at a distance, mandatory consumer rights may apply, including pre-contract information and, where applicable, a statutory withdrawal period.
The right of withdrawal may be limited or excluded in specific cases allowed by law, for example where a service has been fully performed with the consumer's prior consent or where personalised or urgent work has started under legally valid conditions.
Nothing in these terms limits mandatory consumer rights that cannot be excluded under applicable law.
13. Liability
SystemService is not liable for indirect damage, loss of profit, loss of business, loss of data, reputational damage or damage caused by incorrect or incomplete information provided by the customer, except where liability cannot be excluded by law.
For repair-related work, liability is limited to the specific service performed and does not cover unrelated defects, pre-existing issues, user modifications, third-party intervention, liquid damage, mechanical damage or improper use.
Nothing in these terms excludes liability for intent, gross negligence or other liability that cannot be excluded under applicable law.
14. Suspension and termination
A subscription or access right may end by cancellation, expiry, non-payment, breach of these terms or a separate written agreement.
After termination, access to the platform may be limited or removed. Data export, deletion or retention may be handled according to the applicable agreement, privacy policy and legal requirements.
15. Changes to these terms
SystemService may update these terms when the service, platform, legal requirements or business model changes.
For ongoing services, material changes will apply according to the applicable agreement, legal requirements or reasonable notice where required.
16. Governing law and disputes
These terms are governed by the laws of the Netherlands, unless mandatory consumer law provides otherwise.
Disputes will be handled by the competent court or authority under applicable law, unless another valid written arrangement applies.
